Cutting tables: including 11 ft for large project needs.

PopUp Market: The 1st Thursday of each month from 6:00 – 9:30 pm the front of the studio turns into a retail shop for you to sell your one of a kind creations. Members are able to reserve a table at no cost. This event coincides with the Lower Polk Street Art Walk. Sips N Sews is a publish stop on the Art Walk map with monthly distribution of 10k .

Library: Our well stocked library has books, magazines and templates on a variety of sewing topics for your reference. Enjoy the current issues of popular sewing magazines.

Sipping: The Sips of Sips N Sews is a self serve Tea Bar with every type of tea cup/saucer, tea pot, mug for any mood one is in. The Sipping area is perfect for lunch or a few of online tasks with your mobile device.

Wireless Device Charging Station: Available for your charging needs.

MEMBERSHIP AGREEMENT
You agree by purchase of a membership or service, you are agreeing to all terms and conditions in this Agreement. You also agree to follow Sips N Sews’ membership policies and all studio rules. Sips N Sews may, at its sole discretion, modify the policies and any facility rule without notice at any time.

STUDIO USAGE:
All Notions must be attached to project in studio
No Pets allowed in any part of studio
No smoking in any part of the studio
No food is allowed on machine or work tables
Cell Phones Conversations allowed is Sipping Area
Pincushions must be used at all times
Quartz topped table is for Ironing ONLY
Return all tools and notions to Notions Wall


I have in person, operated, maintained and have the knowledge to troubleshoot the industrial sewing equipment available for use at Sips N Sews. I acknowledge and understand that Sips N Sews, Inc. does not provide education, tutorials, support or advice on the operation or maintenance of the following list of industrial sewing equipment. I, acknowledge and understand, as the Member have complete responsibility to self enforce, which includes, refraining from operating any equipment in which, that I lack the experience, knowledge, education to operate, maintain and have knowledge to troubleshoot such equipment in a safe and effective manner.

Your membership permits you to use Sips N Sews’ premises, facilities, equipment and services (collectively called “Facilities”) as shown and limited by the membership identified in this Agreement. Your membership is non-transferable by you and gives you no rights in Sips N Sews, its management, property, or operation. Sips N Sews may assign or transfer your membership in its sole discretion. Sips N Sews can sell memberships at different rates and terms then yours. Any special promotional membership or rate regarding privileges, usage, hours, or Facilities is valid only at the facilities enrollment. It is your responsibility to notify Sips N Sews of any change in your address or phone number.
Your all facility privileges are limited to those benefits identified at the time of this purchase. Sips N Sews reserves the right to charge an extra fee and /or extra dues for your use of any service or product not included in your in the Agreement at the time you enrolled.
Membership Pause: Sips N Sews will only pause your membership, upon receipt of written notification to mymembership@sipsnsews.com. Written notice must be received 30 (thirty) days prior date pause request begins, reactivation date must accompany notification. Any notification that does not contain reactivation date with be considered invalid.
Financial Policy
Dues & Fees: You agree to pay the Dues and Fees listed on this Agreement. All prepaid monthly Dues are not refundable. Whether or not you use the Facilities, you must still pay your monthly Dues. You agree to pay Sips N Sews an administrative fee for any declined credit/debit card transaction, or other debit problems, such as but not limited to non-sufficient funds, closed account, frozen or declined credit or similar circumstances. The current fee is included in this agreement, this fee is subject to change at Sips N Sews sole discretion without prior notice.
Right to Increase Dues: Sips N Sews may increase your monthly dues upon 30 days written notice to the address on this agreement.
Charges & Taxes: If you or your guest incur any Sips N Sews charges for good or service that include, without limitation, classes, supplies, notions, fabric, or similar services, you agree to pay for them according to Sips N Sews rates and practices then in effect. Sips N Sews has the right to add any such rate to your monthly EFT Dues. Sips N Sews has the right in its sole discretion to add any utility charges or surcharges to your Prepaid Dues and monthly EFT Dues.
Automatic Monthly Deductions & Timely Payments: You have full control over the EFT and can stop it anytime by notifying Sips N Sews, in writing, 30 (thirty) days before the 1st of a calendar month. You must notify Sips N Sews within 60 days of a claimed EFT error on your bank statement of credit card statement. If you EFT ends for any reason, your membership may be immediately suspended at Sips N Sews election. You will have 30 days from the date your EFT ends. Upon reinstatement, all past due amounts, including any administrative fees will be electronically deducted or you must pay all past due amounts at the time of reinstatement if prepaying.
Unavailability of limited hours of Facilities and services
Unavailability: Sips N Sews regularly closed its Facilities for maintenance, selected Holidays and other hours based on municipal requirements. Not all Facilities or services are open and available during the same hours. If facility is closed or unavailable for more than 10 days, except for acts of nature, Sips N Sews will extend your membership for the same period your facility was closed or completely unavailable, unless there is a facility open and available within 10 miles of the facility that you enrolled at. Sips N Sews may delete, change, discontinue, repair, or replace any part of the facility or services without any effect on this Agreement. Any of the facilities or services including but not limited to, classes, equipment, notions, refreshments, and staff may be discontinued altogether at any time and may be offered on a “first come first served basis”. Sips N Sews reserves the right to charge a separate participation or reservation fee for any facility or service.
Closure, Move, or Sale of Facility: Sips N Sews may permanently close or move your facility of enrollment without any effect on this Agreement if it transfers your membership to another facility within 10 miles of the one affected
Physical Condition & No Medical Advice: You represent that you are in good physical condition and have no medical reason or impairment that might prevent you from your intended use of Sips N Sews Facility and the equipment as available. Upon signing this Agreement you advise Sips N Sews you have no physical or mental concerns that would limit your abilities to use and operate any and all equipment on the premises.
Liability for Property: Sips N Sews is not liable to you for any personal property that is damaged, lost or stolen while on or around Sips N Sews premises including, but not limited to, any property left in a locker or anywhere in facility. If you or your guest cause any damage to Sips N Sews facilities and the contents of the facility, including but not limited to all sewing machines, scissors, forms, and all supplies, you are liable to Sips N Sews for its cost of repair or replacement.
Entire Agreement & Enforcement: You acknowledge that neither Sips N Sews, nor anyone else, made an representations or promises upon which you relied that are not stated in this Agreement. Handwritten changes to this Agreement are not valid. This is the entire agreement between you and Sips N Sews and replaces any oral or other written agreement. If a court declares any part of this Agreement invalid, it will not invalidate the remaining parts, which continue unaffected. If Sips N Sews does not enforce any right in this Agreement for any reason, Sips N Sews does not waive its right to enforce it later.
Cancellation, Termination, Refund
Cancellation Rights: Processing and membership dues are non-refundable, unless specifically stated otherwise below.
Termination of Monthly Membership: You may terminate your Monthly Membership at any time upon (1) one month written notice to Sips N Sews. Your monthly membership within one calendar month following the month Sips N Sews receives the written notice. Notice of termination must be received at least thirty (30) business days before your EFT bill date to allow Sips N Sews sufficient time to process your termination. If your termination notice is not received at least thirty (30) business days before your EFT bill date, your Monthly membership ends the second month following the month Sips N Sews receives written notice. Sips N Sews will apply your last month Dues to you last month.
Termination for Cause by Sips N Sews: Sips N Sews may, at its option, terminate your membership if (1) you fail to complete all signature lines and required initial blocks, (2) you fail to make timely payments under any payment plan, (3) any monthly payments or Dues are late, (4) the monthly EFT payments or Dues are interrupted or discontinued for any reason and you or your co-signer do not provide an acceptable alternative, (5) you fail to follow any of Sips N Sews Membership Policies or Facility rules or violate any part of this Agreement, or (6) your conduct is improper or harmful to the best interest of Sips N Sews or its members. Termination is effective on the date Sips N Sews mails a written notice to your last known address. You are liable for all financial obligations until that date.
Arbitration
If there is any dispute or claim between you and Sips N Sews involving an amount in controversy of more than Two Thousand ($2,000.00), or if your dispute or claim is or could be designated as a class action, you and Sips N Sews agree to submit the dispute for resolution to binding arbitration using the American Arbitration Association's (AAA) Commercial Arbitration Rules (AAA Rules) in effect on the date of this Agreement, except as to those AAA Rules that conflict with or differ from this Agreement. Unless controlling legal authority requires otherwise, there shall be no right or authority for any dispute to be heard or arbitrated on a class action basis, as a private attorney, or on a basis involving disputes brought in a purported representative capacity on behalf of the general public, provided, however, that any individual claim is subject to this agreement to arbitrate. You and Sips N Sews agree that the provisions of this Agreement supersede any provision of the AAA Rules. Arbitration mans that neither you nor Sips N Sews can sue each other in a court over the dispute and that a neutral arbitrator will decide it , not a jury or judge.
To start the arbitration process, notwithstanding any statute of limitation that would apply in the absence of this agreement, either party must submit a written arbitration request to the other within one year of the date the party asserting the claim had knowledge of any fact(s) which form the basis for the claim, Any failure to request arbitration with the one year period , shall constitute a waiver of all rights to raise any claim and consent to dismissal of any claim brought more the one year after knowledge of any fact(s) which form the basis for the claim.
The arbitration shall be held at the AAA office nearest to the club you joined. The law of the state where you enrolled governs the dispute. If the dispute involves the terms of this Agreement or the financial obligations under this Agreement, then the parties agree they cannot conduct any discovery of any kind, which means that neither party can demand that the other produce documents, take any depositions, or request written response to discovery. This limitation on discovery shall not apply to the extent that the law of the state where you enrolled requires that parties to an arbitration agreement be permitted to conduct discovery.
Facilities, representations, personal injury, property, contract, and tort damage of any kind. If there is any dispute over the applicability of arbitration or the validity of the Assumption of Risk/Waiver provisions, only an Arbitrator, not a court, may decide the dispute, which the Arbitrator must determine in a separate hearing before arbitration may proceed.
If it is determined by the arbitrator or by a court that any part of a claim or dispute is not subject to arbitration under this Agreement, the parties hereby acknowledge, agree and stipulate that the part of the claim or dispute that is not subject to arbitration shall be stayed pending completion of the arbitration.
Each party will pay its own expenses, including attorney's fees and costs. Any judgment on the arbitrator's award may be entered in any court having jurisdiction. The arbitration award shall be complete and final, and the parties waive all rights to appeal or any right to challenge the award. The parties shall not disclose the existence, contents , or results of the arbitration without the written consent of both parties.
Limitation of Liability: Any award by an Arbitrator or a Court is limited to the terms on this Agreement, unless otherwise expressly provided for under state law. Neither an Arbitrator nor a Court can award either party any indirect, incidental or consequential damages, even if one party told the other party that they might suffer these damages.

By purchasing, I acknowledge and agree that I have read the foregoing and know of the nature of the activities at Sips N Sews, Inc., and you agree to all the terms, rules and regulations, hereby, set forth in this agreement in the county of San Francisco, State of California;

Business Storage

On-site storage for Specialist Members. Storage units are semi-secured. Storage is accessible during business hours.

All stored items must fit in assigned area. All items must be stored with a minimum of a 2 inch clearance from floor. It is suggested that all items, boxes or other containers are stored on a pallet or equivalent system.

Sips N Sews management has the right to inspect storage unit at any time. Sips N Sews reserves the right to authorize government agencies entrance with/without written notice.

The above rules must be adhered to; in the event that the Monthly Storage Policy is violated the contains that are unauthorized and violate usage policy will be removed and disposed of, any fees or costs associated with the disposing of unauthorized items will be charged to member's account. Remaining contains will be confiscated.

All confiscated items will be held for up to 30 days. At the end of the 30 day period, all items will be donated to local charitable organizations.

You must notify Sips N Sews within 60 days of a claimed EFT error on your bank statement of credit card statement. If you EFT ends for any reason, your membership may be immediately suspended at Sips N Sews election. You will have 30 days from the date your EFT ends. Upon reinstatement, all past due amounts, including any administrative fees will be electronically deducted or you must pay all past due amounts at the time of reinstatement if prepaying.
Unavailability of limited hours of Facilities and services
Unavailability: Sips N Sews regularly closed its Facilities for maintenance, selected Holidays and other hours based on municipal requirements. Not all Facilities or services are open and available during the same hours. If facility is closed or unavailable for more than 10 days, except for acts of nature, Sips N Sews will extend your membership for the same period your facility was closed or completely unavailable, unless there is a facility open and available within 10 miles of the facility that you enrolled at. Sips N Sews may delete, change, discontinue, repair, or replace any part of the facility or services without any effect on this Agreement. Any of the facilities or services including but not limited to, classes, equipment, notions, refreshments, and staff may be discontinued altogether at any time and may be offered on a “first come first served basis”. Sips N Sews reserves the right to charge a separate participation or reservation fee for any facility or service.
Closure, Move, or Sale of Facility: Sips N Sews may permanently close or move your facility of enrollment without any effect on this Agreement if it transfers your membership to another facility within 10 miles of the one affected
Physical Condition & No Medical Advice: You represent that you are in good physical condition and have no medical reason or impairment that might prevent you from your intended use of Sips N Sews Facility and the equipment as available. Upon signing this Agreement you advise Sips N Sews you have no physical or mental concerns that would limit your abilities to use and operate any and all equipment on the premises.
Liability for Property: Sips N Sews is not liable to you for any personal property that is damaged, lost or stolen while on or around Sips N Sews premises including, but not limited to, any property left in a locker or anywhere in facility. If you or your guest cause any damage to Sips N Sews facilities and the contents of the facility, including but not limited to all sewing machines, scissors, forms, and all supplies, you are liable to Sips N Sews for its cost of repair or replacement.
Entire Agreement & Enforcement: You acknowledge that neither Sips N Sews, nor anyone else, made an representations or promises upon which you relied that are not stated in this Agreement. Handwritten changes to this Agreement are not valid. This is the entire agreement between you and Sips N Sews and replaces any oral or other written agreement. If a court declares any part of this Agreement invalid, it will not invalidate the remaining parts, which continue unaffected. If Sips N Sews does not enforce any right in this Agreement for any reason, Sips N Sews does not waive its right to enforce it later.
Cancellation, Termination, Refund
Cancellation Rights: Processing and membership dues are non-refundable, unless specifically stated otherwise below.
Termination of Monthly Membership: You may terminate your Monthly Membership at any time upon (1) one month written notice to Sips N Sews. Your monthly membership within one calendar month following the month Sips N Sews receives the written notice. Notice of termination must be received at least thirty (30) business days before your EFT bill date to allow Sips N Sews sufficient time to process your termination. If your termination notice is not received at least thirty (30) business days before your EFT bill date, your Monthly membership ends the second month following the month Sips N Sews receives written notice. Sips N Sews will apply your last month Dues to you last month.
Termination for Cause by Sips N Sews: Sips N Sews may, at its option, terminate your membership if (1) you fail to complete all signature lines and required initial blocks, (2) you fail to make timely payments under any payment plan, (3) any monthly payments or Dues are late, (4) the monthly EFT payments or Dues are interrupted or discontinued for any reason and you or your co-signer do not provide an acceptable alternative, (5) you fail to follow any of Sips N Sews Membership Policies or Facility rules or violate any part of this Agreement, or (6) your conduct is improper or harmful to the best interest of Sips N Sews or its members. Termination is effective on the date Sips N Sews mails a written notice to your last known address. You are liable for all financial obligations until that date.
Arbitration
If there is any dispute or claim between you and Sips N Sews involving an amount in controversy of more than Two Thousand ($2,000.00), or if your dispute or claim is or could be designated as a class action, you and Sips N Sews agree to submit the dispute for resolution to binding arbitration using the American Arbitration Association's (AAA) Commercial Arbitration Rules (AAA Rules) in effect on the date of this Agreement, except as to those AAA Rules that conflict with or differ from this Agreement. Unless controlling legal authority requires otherwise, there shall be no right or authority for any dispute to be heard or arbitrated on a class action basis, as a private attorney, or on a basis involving disputes brought in a purported representative capacity on behalf of the general public, provided, however, that any individual claim is subject to this agreement to arbitrate. You and Sips N Sews agree that the provisions of this Agreement supersede any provision of the AAA Rules. Arbitration mans that neither you nor Sips N Sews can sue each other in a court over the dispute and that a neutral arbitrator will decide it , not a jury or judge.
To start the arbitration process, notwithstanding any statute of limitation that would apply in the absence of this agreement, either party must submit a written arbitration request to the other within one year of the date the party asserting the claim had knowledge of any fact(s) which form the basis for the claim, Any failure to request arbitration with the one year period , shall constitute a waiver of all rights to raise any claim and consent to dismissal of any claim brought more the one year after knowledge of any fact(s) which form the basis for the claim.
The arbitration shall be held at the AAA office nearest to the club you joined. The law of the state where you enrolled governs the dispute. If the dispute involves the terms of this Agreement or the financial obligations under this Agreement, then the parties agree they cannot conduct any discovery of any kind, which means that neither party can demand that the other produce documents, take any depositions, or request written response to discovery. This limitation on discovery shall not apply to the extent that the law of the state where you enrolled requires that parties to an arbitration agreement be permitted to conduct discovery.
Facilities, representations, personal injury, property, contract, and tort damage of any kind. If there is any dispute over the applicability of arbitration or the validity of the Assumption of Risk/Waiver provisions, only an Arbitrator, not a court, may decide the dispute, which the Arbitrator must determine in a separate hearing before arbitration may proceed.
If it is determined by the arbitrator or by a court that any part of a claim or dispute is not subject to arbitration under this Agreement, the parties hereby acknowledge, agree and stipulate that the part of the claim or dispute that is not subject to arbitration shall be stayed pending completion of the arbitration.
Each party will pay its own expenses, including attorney's fees and costs. Any judgment on the arbitrator's award may be entered in any court having jurisdiction. The arbitration award shall be complete and final, and the parties waive all rights to appeal or any right to challenge the award. The parties shall not disclose the existence, contents , or results of the arbitration without the written consent of both parties.
Limitation of Liability: Any award by an Arbitrator or a Court is limited to the terms on this Agreement, unless otherwise expressly provided for under state law. Neither an Arbitrator nor a Court can award either party any indirect, incidental or consequential damages, even if one party told the other party that they might suffer these damages.

All stored items must fit in assigned area. All items must be stored with a minimum of a 2 inch clearance from floor. It is suggested that all items, boxes or other containers are stored on a pallet or equivalent system.

Sips N Sews management has the right to inspect storage unit at any time. Sips N Sews reserves the right to authorize government agencies entrance with/without written notice.

The above rules must be adhered to; in the event that the Monthly Storage Policy is violated the contains that are unauthorized and violate usage policy will be removed and disposed of, any fees or costs associated with the disposing of unauthorized items will be charged to member's account. Remaining contains will be confiscated.

All confiscated items will be held for up to 30 days. At the end of the 30 day period, all items will be donated to local charitable organizations.

RISK OF LOSS OR DAMAGE: Sips N Sews shall have no liability for damage to or loss of property place in Member’s Storage Space caused by heat, cold, theft, vandalism, fire, water, winds, dust, rain, explosion, rodents, insects or any other cause whatsoever. Sips N Sews carries no insurance covering damage to or loss of Member’s property. Member agrees to “self insure” Member’s property to the same extent as such a policy would have provided. Sips N Sews shall not be deemed to either expressly or impliedly provide any security protection to the Member’s property stored in the Storage Space. Any security devices which Sips N Sews may maintain are for Sips N Sews’s convenience only. Sips N Sews may discontinue its use of any security device in whole or in part at any time without notice to Member. Sips N Sews shall not be liable to Member or Member’s invitees for personal injuries or damage to Member’s property caused by any act or negligence of Sips N Sews or any other person on the premises. Member hereby agrees to indemnify and to hold harmless Sips N Sews from any and all claims, including claims for which Sips N Sews is or is alleged to be negligent, for damages to property or personal injury and costs, including attorneys’ fees, arising from Member’s use of the Storage Space.

USE OF STORAGE SPACE: The Storage Space shall not be used for any unlawful purpose and shall be kept in good condition by Member. Member shall not use the Storage Space to store any flammable, combustible, explosive, corrosive, chemical, odorous, perishable, noxious, or other inherently dangerous materials. Member shall not use the storage space for active storage, i.e., manufacture, fabrication or maintenance. Member warrants that all items placed by Member in the storage space shall be Member’s own property or property which Member is legally entitled to possess. Member shall not place any property or material outside the Storage Space. Any property or material found outside the Storage Space shall be conclusively presumed to be abandoned and may be disposed of by Sips N Sews without notice or liability to Member. Member shall not make any alterations to the Storage Space nor post any signs without the express written consent of Sips N Sews.

SIPS N SEWS RIGHT TO ENTER, INSPECT, REPAIR: Upon the request of Sips N Sews, Member shall provide the Sips N Sews, its agents or employees, access to the Storage Space for the purpose of inspection, repair, alteration, improvement, or to supply necessary or agree services. In case of an emergency, Sips N Sews may enter Member’s storage space for any of the above-stated purposes without notice to or consent from Member and Sips N Sews retains the right to remove the property in the storage space to another space or facility. For the purpose of this Paragraph, the term “emergency” means any sudden, unexpected occurrence or circumstance which demands immediate action.

EXCLUSIONS OF ALL WARRANTIES: Member agrees that Sips N Sews have not made and make no representations of warranties of any kind or nature, directly or indirectly, expressed or implied, as to any matter whatsoever related to the Storage Space and facility. Sips N Sews’s oral statements do not constitute warranties, and shall not be relied upon by the Member, nor shall any of said statements be considered a part of this Rental Agreement. The entire agreement and understanding of the parties is hereto embodied in this writing and no other warranties are given beyond those set forth herein. It is further understood and agreed that Member has been give an opportunity to inspect and has inspected the Storage Space, and that Member accepts the Storage Space as is and with all faults.

MISCELLANEOUS: A. Member is aware that staff is may not be available outside of normal office hours and all inquiries, issues, or questions can be addressed during those hours ONLY. B. This Rental Agreement contains the entire agreement between the parties hereto and supersedes any prior written or oral agreements. No amendment or alteration hereto shall be binding unless set forth in writing and signed by both Sips N Sews and Member. C. Member hereby waives trial by jury in any action, proceeding or counterclaim brought on any and all matters arising out of this Rental Agreement or the use of occupancy of the Storage Space.
